Background: This Petition has been preferred under Section 86 (1) (f) of the Electricity Act, 2003 (“the Act” for short) read with Regulations 23 and 80 of the GERC (Conduct of Business) Regulations, 2004 for quashing and setting aside the action of the Respondents of illegally seeking to demand POC from the Petitioners based on entire installed capacity of the Petitioners’ CPPs.
