MERC rejects petition of Adani Power v/s MSEDCL seeking declaration of Change in Law in respect of revision in the Fees

Background: Adani Power Maharashtra Limited (APML) has filed Petition on 02 November 2023 under Section 86 of the Electricity Act (EA), 2003 read with Article 13 of the Power Purchase Agreement (PPA) dated 08 September 2008 for 1320MW and Article 10 of the PPA dated 31 March 2010, 9 August 2010 and 16 February 2013 of 1200 MW, 125 MW and 440 MW respectively executed between APML and Maharashtra State Electricity Distribution Company Limited (MSEDCL) in respect of revision in the Fees for Consent to Operate (CTO) Fees notified vide Notification dated 25 August 2011 by the Maharashtra Pollution Control Board (MPCB), Government of Maharashtra (GoM) and levy of Add-on charges by Western Coalfields Limited (WCL) for supply of coal.
