Background:

The present Petition has been filed by the Petitioner, Damodar Valley Corporation (DVC) under Section 79(1)(f) of the Electricity Act, 2003 (hereinafter referred to as “the Act”) seeking a declaration that DVC is entitled to appropriate payment made by BSES  Yamuna Power Limited (BYPL) first towards Late Payment Surcharge (LPSC) and thereafter towards principal dues, along with consequential relief for payment of the outstanding LPSC.
